§ 1 Introductory Provisions
The legal basis for these Terms and Conditions is Article 5 and Article 8, Section 1, Item 1 of the Act of 18 July 2002 on the provision of services by electronic means, the Act of 12 July 2024, the Electronic Communications Law, and the Act of 30 May 2014, on consumer rights.
The Terms and Conditions define the rules for the provision of the newsletter service, which constitutes an agreement for the provision of digital content, the procedure for concluding and terminating the agreement, the complaint procedure, and the out-of-court dispute resolution process.
The Service Provider, within the meaning of these Terms and Conditions, is Paweł Surdel, conducting business under the name “PAPS CUSTOM TOOLS PAWEŁ SURDEL”, with its registered office at ul. Gajowa 19, 44-145 Leboszowice, Poland, Tax Identification Number (NIP): 9691547472.

§ 2 Definitions
1. Website – the website at https://papstomahawks.com/, including all subpages.
2. Subscriber – a natural person who has agreed to receive the newsletter and has been added to the list of subscribers.
3. Newsletter – a service provided electronically, consisting of sending commercial, marketing, and educational information to subscribers via email.
4. Digital Content – data produced and delivered in digital form, including educational materials, e-books, and webinars provided as part of the newsletter. 5. Payment by Data – providing personal data (email address, name) in exchange for access to digital content.
§ 3 Newsletter Service
The newsletter service consists of sending subscribers information about:
new products offered by the Service Provider
promotions and discounts
educational content
events and training
materials available on the website
The newsletter may contain educational materials in the form of digital content (e-books, infographics, recordings).
The service is provided free of charge in exchange for providing personal data (payment by data).
§ 4 Newsletter Subscription
Subscription to the newsletter is achieved by:
Completing the subscription form on the website
Providing an email address and name
Checking the appropriate consents
§ 5 Subscriber Consents
By confirming the subscription, the Subscriber consents to:
Processing of personal data for the purpose of receiving the newsletter
Sending commercial information in accordance with the Act on the Provision of Electronic Services
Use of telecommunications terminal equipment for direct marketing
Consents are voluntary, but necessary for the provision of the newsletter service. The Subscriber may withdraw consent at any time without affecting the lawfulness of the processing carried out so far.
§ 6 Technical Requirements
Using the newsletter service requires:
a device with internet access
an active email account
a web browser that supports HTML5
cookies enabled
§ 7 Unsubscribing from the Newsletter
The subscriber may unsubscribe from the newsletter at any time by:
clicking the “Unsubscribe” link in the footer of the message

The consumer has the right to withdraw from the contract without giving any reason within 14 days of its conclusion.
§ 8 Delivery of Digital Content
Digital content is delivered immediately after the conclusion of the contract.
The content is deemed delivered when the subscriber is provided access to it. The Service Provider may make changes to the content for legitimate reasons, providing subscribers with 7 days’ notice.
§ 9 Responsibility for Compliance
The Service Provider is responsible for ensuring that the digital content complies with the contract.
In the event of non-compliance, the Consumer may request that it be brought into compliance or withdraw from the contract.
§ 10 Complaints

A complaint should include:
contact details of the complainant
description of the problem
expectations related to the complaint
Complaints are reviewed within 14 days.
§ 11 Personal Data
The controller of personal data is PAPS CUSTOM TOOLS PAWEŁ SURDEL. Data is processed based on consent (Article 6(1)(a) of the GDPR) for the purposes of:
providing the newsletter service
direct marketing
compliance with legal obligations
Subscribers have the right to:
access data

§ 12 Amendments to the Terms and Conditions
These Terms and Conditions may be amended for important reasons.
Subscribers will be notified of any changes 14 days in advance.
Failure to object within 14 days constitutes acceptance of the changes.
§ 13 Final Provisions
These Terms and Conditions are subject to Polish law.
Disputes will be resolved by the court having jurisdiction over the Service Provider’s registered office.
The Terms and Conditions are effective from July 29, 2025.
