These Terms and Conditions define the rules for using the online store at https://papstomahawks.com/, including the rules for placing orders, concluding contracts, delivery, payment, the right of withdrawal, and complaint procedures.
Language Versions and Precedence of the Polish Version. The document is also available in an English version. For consumers in Poland, the contract is concluded in Polish, and in case of discrepancies between the English and Polish versions, the Polish version shall have interpretative precedence. Confirmation of the conclusion of the contract, along with these Terms and Conditions, will be sent on a durable medium (PDF to an e-mail address) immediately after placing the order.

- DEFINITIONS
Buyer – a natural person with full legal capacity, a legal person, or an organizational unit without legal personality but having legal capacity, who purchases Products in the Store.
Consumer – a natural person making a purchase for purposes not directly related to their business or professional activity; also includes an entrepreneur with consumer rights (when the contract is not of a professional nature for them).
Entrepreneur – an entity purchasing Products in direct connection with their business activity, excluding an entrepreneur-consumer.
Cart – a virtual list of selected Products.
Product – handmade axes, tomahawks, and related tools offered in the Store.
Terms and Conditions – this document.
Sales Agreement – a distance contract concluded between the Seller and the Buyer.
Order – a declaration of will by the Buyer concerning the purchase of specific Products.
Business Day – Monday–Friday, excluding public holidays in Poland.
- GENERAL PROVISIONS AND PRODUCT INFORMATION
2.1 Scope of Application
These Terms and Conditions apply to all purchases made in the Store. Before placing an Order, the Buyer must read and accept the Terms and Conditions. The final order button is clearly marked, e.g., “Order with obligation to pay.”
2.2 Classification and Nature of Products
- Nature: The Products are artisan tools intended for, among other things, bushcraft, camping, woodwork/forestry, historical reenactments, collecting, and other outdoor or professional activities.
- Legal Classification: tools/products (e.g., HS 8201), not weapons; they have exposed cutting edges and are not designed for concealment.
- Intended Use: functional tools and collector’s items; they are not sold as weapons for combat or self-defense.
2.3 Age and Safety
- Age: Sales are restricted to persons of legal age (18+).
- Age Declaration: By placing an Order, the Buyer declares that they are at least 18 years old; we may request proof of age where required by law or the carrier.
- Safety: Keep out of reach of minors; responsibility for safe and lawful use rests with the Buyer.
2.4 Compliance with Local Law, Territorial Scope, and Geoblocking
- Buyer’s Responsibility: Before purchasing, the Buyer must verify local regulations (e.g., customs authorities).
- Seller’s Restrictions: We may refuse/cancel an Order if shipping would violate the law of the destination country.
- Geoblocking: We do not apply unjustified geoblocking; the list of delivery countries may be limited and is visible at checkout.
- Australia and USA: The import of sharp tools may be subject to federal and state/territorial requirements. The Buyer should ensure that local laws permit the import and possession of the ordered products.
2.5 Prices, VAT, Currency, and Payment Fees
- Currency: Prices are in PLN; other currencies are for informational purposes; the final amount depends on the exchange rate/fees of the payment operator.
- VAT in the EU (B2C): Up to the threshold of €10,000 – Polish VAT (23%); after exceeding – the VAT of the consumer’s country (OSS); the rate is visible at checkout.
- Poland: Prices include 23% VAT; EU B2B: reverse charge is possible (after verification of EU VAT ID); Outside the EU: no VAT, any customs duties/taxes are the responsibility of the Buyer.
- Australia (GST): For low-value imported goods (LVIG) and goods above the import threshold, taxes/duties may be collected at checkout or upon import, in accordance with regulations. The current settlement status will be shown at checkout.
- USA: We do not charge VAT. Customs duties, import taxes, and any state/local taxes may be collected upon import or by the carrier/broker. If the law requires the Seller to collect sales tax, this information and the amount will be visible at checkout.
2.6 Price Reductions and Reviews (Omnibus Directive)
- When offering discounts, we display the lowest price from the last 30 days (or since the product’s introduction).
- Reviews: We inform whether and how we verify that reviews come from actual buyers; we do not manipulate reviews.
2.7 Accessibility (EAA)

- PLACING AN ORDER
3.1 Order Steps
Add Products to the Cart → fill out the form → select delivery and payment → review the summary → accept the Terms and Conditions and Privacy Policy → click the “Order with obligation to pay” button.
3.2 Conclusion of the Contract and Durable Medium
We send an automatic confirmation of Order receipt. The contract is concluded when we send a message confirming acceptance for processing or at the moment the Product is dispatched. The confirmation, along with these Terms and Conditions, is provided on a durable medium (PDF via e-mail). We may refuse to process an Order (e.g., lack of availability, payment issues) – in which case we will promptly refund the payment.
3.3 Lead Times
- Ready to ship: up to 5 business days.
- Made to order: up to 28-35 business days.
- Personalized: 28–35 business days.
The longest lead time applies to the entire Order; a maximum of 30 days from the conclusion of the contract (unless otherwise agreed with the Consumer).
3.4 Product Unavailability
In case of unavailability, we will inform you within 14 days and propose a delay, a suitable replacement, or a full refund. No response within 7 days results in cancellation and a refund.
- PAYMENTS
PayPal – processed by PayPal (Europe) S.à r.l. et Cie, S.C.A.; Bank transfer (PL) – account details are provided at checkout and/or in the confirmation. Payment term: 7 days from Order confirmation; processing after payment is credited; unpaid Orders are automatically canceled.
- DELIVERY, INSPECTION, AND RISK
5.1 Shipping Destinations
We ship within Poland and to selected EU countries, the USA, and Australia.
5.2 Inspection and Transport Damage
Please report any damage immediately (with photos). Failure to inspect upon receipt does not limit the Consumer’s rights.
5.3 Transfer of Risk
Consumers: upon physical delivery (unless a carrier chosen by the Consumer was used). Entrepreneurs: upon dispatch from the warehouse.
5.4 Australia — Delivery Terms, Customs, and GST
- Default Delivery Terms: DAP (Delivered At Place) — import taxes and duties are the Buyer’s responsibility, unless indicated otherwise at checkout.
- Customs Clearance: The Buyer is responsible for completing customs formalities and paying fees in Australia. We may require data necessary for clearance.
- Age/Regulation Verification: The carrier or authorities may require confirmation of legal age and compliance of the goods with local law; inability to clear customs for legal reasons will result in the return of the goods to the Seller and a refund of the price minus logistical costs, unless the law provides otherwise.
5.5 USA — Delivery Terms, Customs, and Taxes
- Default Delivery Terms: DAP (Delivered At Place). Customs duties, taxes, and import fees are borne by the Buyer, unless indicated otherwise at checkout.
- Customs Clearance: For clearance in the USA, customs authorities or the carrier may require the recipient’s data for import purposes. Inability to clear customs for legal reasons will result in the return of the goods to the Seller and a refund of the price minus logistical costs, unless the law provides otherwise.
- Local Regulations: State and local regulations concerning tools/blades may impose restrictions on their possession or carrying. The Buyer is obliged to verify these regulations before purchasing.
- INVOICES
Electronic invoices (PDF) are sent via e-mail. At the Consumer’s request – within 3 months from the end of the delivery month. In Poland – no later than the 15th day of the following month (if required by law).
- CONFORMITY OF GOODS AND LIABILITY
7.1 Handcrafted Nature
Minor variations are a natural feature of handcrafted products and do not constitute a defect.
7.2 Lack of Conformity (Consumers)
We are liable for any lack of conformity that becomes apparent within 2 years. Entitlements: first, repair or replacement; then, a price reduction or withdrawal from the contract (subject to the non-materiality of the defect).
7.3 Entrepreneurs – Exclusion of Statutory Warranty
In B2B relations, liability under the statutory warranty (Polish Civil Code) is excluded to the fullest extent permissible by law.
- COMPLAINTS
Complaints: via e-mail or post with the Order number, a description, and (if possible) photos. We will respond within 14 calendar days; no response equals acceptance of the complaint.
- WITHDRAWAL FROM THE CONTRACT (CONSUMERS)
9.1 Deadline and Form
14 days from taking possession of the goods; statement via e-mail/in writing; a template is provided in Annex 1 (not mandatory). Failure to inform about the right of withdrawal extends the deadline by 12 months.
9.2 Exclusions
Goods made to the Consumer’s specifications or clearly personalized. “Made to order” products without personalization are generally not excluded.
9.3 Return of Goods and Refund of Payment
Return the goods within 14 days; the cost of return is borne by the Consumer. The price (including the cheapest standard delivery cost) will be refunded within 14 days of the withdrawal statement; we may withhold the refund until we receive the goods or proof of their dispatch.
9.4 Diminished Value
The Consumer is liable for any diminished value of the goods resulting from handling them in a way other than what is necessary to establish their nature, characteristics, and functioning.
- PERSONAL DATA
Controller: Paweł Surdel (PAPS CUSTOM TOOLS). Processing is carried out in accordance with the GDPR for the purposes of contract performance, legal obligations, and legitimate interests. - OUT-OF-COURT DISPUTE RESOLUTION (ADR)
Consumers may use ADR (Consumer Ombudsman, Trade Inspection mediation). Consumers in the EU have access to national ADR entities. The EU ODR platform was closed on July 20, 2025.
Australia and USA: If and to the extent that local laws apply, the Consumer may turn to the relevant consumer protection authorities or use locally available ADR mechanisms in accordance with the law.
- GOVERNING LAW AND JURISDICTION
Polish law applies; protection under the mandatory provisions of the Consumer’s country of residence is preserved (Rome I). Disputes: Consumer – Poland or the country of residence; Entrepreneurs – the court competent for the Seller’s registered office.
Australian and US consumers: These Terms and Conditions do not exclude or limit the statutory rights of consumers to the extent that they are mandatory in their jurisdiction.
- LIMITATION OF LIABILITY (B2B ONLY)
Liability is limited to direct damages up to the value of the Order; no liability for indirect damages/lost profits. This does not apply to Consumers and does not infringe upon statutory rights.
- INTELLECTUAL PROPERTY RIGHTS
The content of the service is the intellectual property of the Seller and is protected by copyright. Unauthorized use is prohibited.
- PRODUCT SAFETY AND RECALLS (EU 2023/988)
The products are sharp tools. We include safety instructions; keep out of reach of minors. Safety contact: safety@papstomahawks.com. In the event of a risk, we may conduct a recall/corrective action and will notify customers on a durable medium; we cooperate with market surveillance authorities in accordance with Regulation (EU) 2023/988.
Outside the EU, including in Australia and the USA, we will cooperate with the relevant product safety authorities (e.g., ACCC/Product Safety Australia, CPSC in the USA) in accordance with applicable regulations, if required.
- FINAL PROVISIONS
We may amend the Terms and Conditions for valid reasons (change in law, new products/payment methods, improvements). Changes do not affect Orders placed previously. The invalidity of one provision does not affect the validity of the others.
